Waka TV respects the intellectual property rights of content creators, copyright holders, and all third parties. We are committed to complying with the Digital Millennium Copyright Act (DMCA) and responding promptly to any legitimate claims of copyright infringement.
This DMCA Policy outlines the procedures for reporting copyright infringement, how we handle takedown requests, and the process for filing counter-notifications if you believe content was removed in error.
Waka TV operates as a service provider and does not host, produce, or store any copyrighted content on its servers. Our service delivers streams from third-party sources over the internet. We do not claim ownership of any content accessible through our platform.
We take copyright infringement seriously and will act swiftly to address valid DMCA takedown notices. Upon receiving a proper notification, we will investigate the claim and take appropriate action, which may include disabling access to the allegedly infringing content.
If you are a copyright owner or an authorized agent and believe that content accessible through Waka TV infringes upon your copyright, you may submit a DMCA takedown notice to our designated copyright agent. Your notice must be in writing and include all required information as outlined in the next section.
Please send your DMCA takedown notice via email to contact@wakatvapp.co.za with the subject line "DMCA Takedown Notice." We aim to review and respond to all legitimate notices within 24 hours of receipt.
For your DMCA takedown notice to be valid and actionable, it must contain the following information: a physical or electronic signature of the copyright owner or authorized agent; identification of the copyrighted work claimed to have been infringed; identification of the material that is claimed to be infringing, including sufficient information for us to locate the material.
Additionally, you must provide your contact information (name, address, telephone number, and email address); a statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and a statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
If you believe that content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated copyright agent. Your counter-notification must include: your physical or electronic signature; identification of the material that was removed and the location where it previously appeared.
You must also include a statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification; and your name, address, telephone number, and a statement that you consent to the jurisdiction of the applicable court in your district and that you will accept service of process from the person who provided the original DMCA notification.
In accordance with the DMCA, Waka TV has adopted a policy of terminating, in appropriate circumstances, the accounts of users or subscribers who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our service or terminate the accounts of any users who infringe upon the intellectual property rights of others, whether or not there is any repeat infringement.
Please be aware that filing a false or misleading DMCA takedown notice may result in legal liability. Before submitting a notice, please ensure that you are the copyright owner or authorized to act on behalf of the owner and that the use of the material is genuinely not authorized. We encourage copyright holders to consider whether fair use, fair dealing, or a similar exception applies before filing a notice.
Waka TV reserves the right to disregard DMCA notices that do not substantially comply with the requirements of the DMCA, or that we believe in good faith are fraudulent, abusive, or submitted in bad faith.
